Intoxicated defendant bites bailiff while being removed from courtroom

TROY – A Moscow Mills man with a pair of outstanding warrants appeared in court Thursday morning allegedly intoxicated while drinking an alcoholic beverage prior to biting a bailiff.
Billy Ray Davis, 33, faces a felony charge of assault and a misdemeanor of resisting arrest after disrupting proceedings in Associate Judge Michael Jacobs’ courtroom.
According to court records, while sitting in the courtroom, Davis frequently interrupted proceedings, despite being told to remain quiet.
Prior to his arrival, a court officer allegedly noticed Davis smelled of alcohol and was acting belligerently outside the justice center.
After telling Davis to remain quiet, a bailiff noticed Davis drinking an orange liquid from a glass bottle. With a “no food or beverages” sign on the outside of the courtroom, the bailiff approached Davis who again interrupted the court proceedings by yelling at Jacobs.
According to court records, the bailiff noted Davis had bloodshot eyes and was swaying back and forth and instructed him he needed to leave the courtroom. Davis refused at which time additional officers assisted in taking him in custody. Davis attempted to jump over a nearby individual, at which time officers grabbed and secured him.
Davis continued to struggle, biting one of the officers, before he was handcuffed and led out of the courtroom. While being removed, he continued to resist “by dropping to the floor” causing officers to drag him out of the courtroom.
After they took him into custody, officers found two 50ml bottles of alcohol and the glass container filled with the orange liquid that smelled like alcohol.
In addition to the new charges, authorities also served the two outstanding warrants charging Davis with driving while intoxicated and operating a motor vehicle in a careless and imprudent manner with no insurance or seat belt.
Davis remains in jail on a $15,000 cash-only bond and is scheduled to appear back in Judge Jacobs courtroom Tuesday afternoon.
